1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Guide Recorder ("we," "us," or "our") regarding your use of the Guide Recorder Chrome extension and associated services (collectively, the "Service").

By installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

2. Description of Service

Guide Recorder is a Chrome browser extension that provides:

• Screen recording and interaction capture capabilities
• Step-by-step guide creation and editing tools
• AI-powered script generation and text-to-speech narration
• Video generation and export functionality
• Multiple export formats (HTML, Markdown, JSON, MP4)

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice.

3. Eligibility

You must meet the following requirements to use the Service:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable laws
• Comply with all local, state, national, and international laws and regulations

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

4. User Account and Responsibilities

4.1 Account Creation

Currently, Guide Recorder does not require account creation for basic functionality. However, certain features may require authentication in the future.

4.2 User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not record or capture content that violates others' rights or privacy
• Not use the Service to create misleading, defamatory, or harmful content
• Not attempt to reverse engineer, decompile, or disassemble the Service
• Not interfere with or disrupt the Service or servers
• Not use automated means to access the Service without permission
• Maintain the security of your device and browser

5. Intellectual Property Rights

5.1 Our Intellectual Property

The Service, including its software, design, text, graphics, logos, and other content, is owned by Guide Recorder and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal or internal business purposes.

5.2 Your Content

You retain all ownership rights to the content you create using the Service ("User Content"). By using the Service, you grant us a limited, worldwide, royalty-free license to:

• Process and store your content to provide the Service
• Generate videos and exports based on your content
• Use anonymized data for service improvement

This license terminates when you delete your content or uninstall the Service.

5.3 Third-Party Content

You are responsible for ensuring that any content you record or include has appropriate permissions and does not infringe on third-party rights.

6. Prohibited Uses

You may not use the Service to:

• Record or capture sensitive personal information without consent
• Create content that violates copyright, trademark, or other intellectual property rights
• Produce misleading, fraudulent, or deceptive materials
• Harass, threaten, or harm others
• Distribute malware, viruses, or harmful code
• Violate any applicable laws or regulations
• Impersonate any person or entity
• Collect or harvest personal information from others
• Engage in any commercial use without a commercial license (if applicable)

7. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.

Key points:

• Most data is stored locally on your device
• Video generation requires temporary server processing
• AI features use third-party services (OpenAI)
• We do not sell your personal information
• You can delete your data at any time

8. Third-Party Services and Links

The Service may integrate with or link to third-party services, including:

• OpenAI for AI-powered script generation
• Text-to-speech services for narration
• Cloud storage services (if configured)

We are not responsible for the content, policies, or practices of third-party services. Your use of third-party services is subject to their respective terms and conditions.

9. Payment and Subscriptions

Guide Recorder is currently provided free of charge. If we introduce paid features or subscriptions in the future:

• Pricing will be clearly displayed before purchase
• Subscriptions will auto-renew unless cancelled
• Refunds will be handled according to our refund policy
• All fees are non-refundable except as required by law

10. Disclaimers and Limitations of Liability

10.1 Service Availability

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any errors or defects will be corrected
• The Service will meet your specific requirements

10.2 Limitation of Liability

To the maximum extent permitted by law, Guide Recorder and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Service interruptions or security breaches
• Errors or inaccuracies in content
• Unauthorized access to your data
• Third-party services or content

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 if no payment was made.

10.3 Indemnification

You agree to indemnify, defend, and hold harmless Guide Recorder and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you create or share using the Service

11. User-Generated Content

11.1 Content Standards

You agree that your User Content will:

• Be accurate and not misleading
• Not infringe on any third-party rights
• Not contain malicious code or harmful elements
• Comply with all applicable laws
• Not violate our content policies

11.2 Content Monitoring

While we do not actively monitor User Content, we reserve the right to:

• Remove or disable access to content that violates these Terms
• Investigate suspected violations
• Cooperate with law enforcement as required
• Terminate accounts for repeated violations

12. Termination

12.1 By You

You may stop using the Service at any time by uninstalling the extension. Your data stored locally will be removed upon uninstallation.

12.2 By Us

We may suspend or terminate your access to the Service immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Pose a security risk
• Abuse the Service or harm other users

12.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• You must uninstall the extension
• Server-stored data will be deleted per our retention policy
• Provisions that should survive termination will remain in effect

13. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes:

• We will update the "Last Updated" date
• We will notify you through the extension or email
• Continued use after changes constitutes acceptance

If you do not agree to the modified Terms, you must stop using the Service.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms at any time.

15.5 Force Majeure

We shall not be liable for any failure or delay due to circumstances beyond our reasonable control.
